Operator hire terms (version v2)

These terms apply when you book a machine operator through the 1ME client portal or otherwise engage 1800 Mr Excavate Pty Ltd (ABN 56 621 554 327) (“we”, “us”) to supply an operator.

Review before go-live. This draft was prepared for operational use with AI assistance. It is not personalised legal advice. Have your solicitor review before you rely on it for disputes.

1. What we supply

We supply operators only — experienced people to operate plant you provide or arrange. We do not wet-hire machines unless a separate written agreement says so. Knowledge, tickets and safe work practice are what we bring to your site.

2. Your obligations

3. Soft hold and confirmation

When you select an available operator and submit a purchase order, we place a soft hold on that operator for the requested dates. The office must confirm the booking before it becomes a firm roster. Until confirmation, we may decline or propose an alternative if tickets, leave, or another commitment conflict. Cancelling a requested booking releases the hold.

4. Tickets, insurance and safety records

Operators work with tickets and insurance held on our records. On each shift our operator completes:

A Take 5 is an operator-level check. It supplements, and does not replace, your SWMS. We do not prepare SWMS on your behalf. If no SWMS is provided for high-risk construction work, our operator may decline to start that work until one is available.

Client-facing scores in the portal are for your matching decisions only and are not a warranty of outcome.

5. Hours and invoicing

Hours are logged against your job. We issue a tax invoice that matches recorded hours, with copies of the prestart, Take 5 and SWMS sign-on records attached when available. Payment is due per the payment terms on your account or invoice. Late payment may attract interest as stated on the invoice.

6. LAFH and travel

For sites over 80 km from Denman base, you must choose LAFH or travel paid. The chosen allowance is noted on the roster and applies for the confirmed shifts unless we agree a change in writing.

7. Cancellations and changes

Tell us as early as practical if dates, site or machine change. Late cancellations after confirmation may be charged for rostered time we cannot reasonably reallocate. Soft-held (not yet confirmed) requests can be cancelled in the portal without charge.

8. Site control and risk

You control the site and remain responsible for site-specific hazards, permits, the SWMS for high-risk construction work, and principal contractor duties. Our operator follows lawful site directions and safe work practice. Nothing in these terms transfers your BYDA, SWMS or principal contractor duties to us.

9. Limitation

To the extent permitted by law, our liability for supply of operators is limited to re-supply of equivalent services or the cost of re-supply. We are not liable for consequential loss arising from plant downtime, weather or third-party delays beyond our reasonable control.

10. Acceptance and version

By ticking acceptance in the client portal (or signing a booking that references these terms), you accept this version v2. We may publish a later version for future bookings; each booking stores the version you accepted.
